The Federal Court of Canada recently held that s.91 (24) of the Constitution Act 1867 applies to Métis and to First Nations people who do not have Indian Act Status (“non-status Indians”) thus bringing these peoples under federal jurisdiction. The potential ramifications of the decision was explored, particularly as this relates to issues of land and natural resources development and use. President Chartier also addressed the recent Supreme Court of Canada decision on the Manitoba Metis Federation s.31 land grant and outlined how this new “honour of the Crown” duty will impact resource development.
